These Terms and Conditions (hereinafter, "T&C") govern access to and use of the cashovanta.com website and the real estate crowdlending services offered by Cashovanta S.A. By accessing or using the site, you accept these T&C in their entirety. If you disagree, please do not use the site or our services.
1. Service provider identification
Cashovanta S.A., a company incorporated under the laws of the Argentine Republic in 2021. Registered address: Av. Corrientes 1425, Floor 8, Office B, C1043AAM, Buenos Aires. CUIT: 30-71856924-3. Registered with the General Inspection of Justice (IGJ) No. 2847/2021. Registered as FCI Placement and Distribution Agent with the National Securities Commission (CNV), License No. 1592.
2. Service description
Cashovanta operates a digital real estate crowdlending platform that allows individual investors to participate in the collective financing of development, construction, renovation, and property appreciation projects in Argentina. The platform acts as an intermediary between investors and real estate developers, facilitating the channeling of funds to specific projects.
3. Participation requirements
To use Cashovanta's investment services, you must: (a) be at least 18 years old; (b) be domiciled in the Argentine Republic; (c) have a valid CUIT or CUIL; (d) complete the registration and identity verification process in accordance with anti-money laundering regulations (UIF); (e) accept these T&C and the Privacy Policy.
4. Nature of investment and risks
Investments made through Cashovanta are subject to inherent risks of the real estate market and the crowdlending model. Projected returns are not guaranteed. There is the possibility of partial or total loss of invested capital. Risk factors include, among others: real estate market fluctuations, delays in project execution, regulatory changes, macroeconomic variations, and counterparty risk. Cashovanta does not guarantee profitability or return of invested capital.
5. User obligations
When using the site and services, you agree to: provide truthful, complete, and up-to-date information; maintain the confidentiality of your access credentials; immediately notify any unauthorized use of your account; comply with current legislation, including tax regulations and anti-money laundering laws; not use the site for illegal or unauthorized purposes.
6. Intellectual property
All content on the website, including but not limited to texts, graphics, logos, images, software, and design, is the property of Cashovanta S.A. or its licensors, and is protected by intellectual property laws of the Argentine Republic and applicable international treaties. Its reproduction, distribution, or modification without prior written authorization is prohibited.
7. Limitation of liability
Cashovanta shall not be liable for: indirect, incidental, or consequential damages arising from the use of the site or investments made; technical service interruptions due to causes beyond our control; the veracity of information provided by project developers, although we conduct reasonable verification processes; investment decisions made by users based on information available on the platform.
8. Communications
By registering, you agree to receive electronic communications related to your account, investments, and platform updates. You can manage your communication preferences from your profile or by contacting us at contacto@cashovanta.com. Legal and regulatory notifications cannot be disabled while you maintain an active account.
9. Modifications
Cashovanta reserves the right to modify these T&C at any time. Modifications will take effect from their publication on the website. In case of substantial changes, we will notify you at least 30 days in advance via email or through a prominent notice on the platform. Continued use of the site after the modifications take effect implies acceptance of the new T&C.
10. Applicable law and jurisdiction
These T&C are governed by the laws of the Argentine Republic. For any dispute arising from the use of the site or Cashovanta's services, both parties submit to the exclusive jurisdiction of the Commercial Courts of the City of Buenos Aires, waiving any other forum or jurisdiction that may apply.
